Acceptance of Terms of Use
The Bloom – Bloom Luxury Bath & Body treats company, based in Athens, Attica (hereinafter the "Company") created the present special place to buy products "under" the domain name bloom-bloomshop.com (hereinafter "eshop") and any information or element (e.g. e.g. documents, files, texts, graphs) contained in it (hereinafter "the Material") with the purpose of providing information to visitors/users of the eshop about the Company, their general information, the products offered to it, as well as and enabling visitors/users to be informed about the market, but also to make purchases of the products advertised through the eshop. The full address and contact details (phone, fax, e-mail) of the Company are provided on the special "Contact" page.
The use of the eshop, the services offered through it and the Material is subject to these Terms of Use, as they apply at any time, which also constitute the agreement between the Company and every person who visits the eshop regarding its use. The use and browsing of the eshop may be subject to network connection costs borne by the user. If the visitor/user does not agree, then he must stop accessing the eshop and not use the services and content of the Company's eshop. Accessing and using the eshop in any way (including simply navigating it) signifies the user's unreserved acceptance of the Terms of Use, as they apply at any given time.
The visitor/user may communicate with the Company and the eshop according to the details listed on the special "Contact" page.
Modification of Terms of Use
The Company reserves the right to modify the Terms of Use and any other rule governing the use of the Eshop at its absolute discretion. Use of the Eshop is subject to the Terms of Use in effect at the time of use. The user must periodically check the Terms of Use, in order to be informed of their content.
Conditions for making purchases
Each user/visitor may purchase the products advertised through the Eshop.
The user/visitor can choose the products he wants from those offered. The Company may freely add and remove products to the Eshop. The Company is not responsible for the availability of the product, which it exposes exactly as it is conveyed by the advertised supplier of the product. The simple search for a product does not imply the obligatory purchase of it.
The prices of the advertised products for the entire period indicated include VAT – if subject to it – but do not include shipping costs, which are however analyzed before the order is completed.
After selecting the product, the user fills in the relevant shipping information and selects the payment method and then completes the order. However, before making the purchase, he can confirm the purchase of the products he wants, in order to correct any wrong choices through the existence of an electronic basket. Afterwards, an informative e-mail is sent to the user/visitor with details of the purchase, the product, the price and any shipping costs, at which point the purchase/order is considered complete. The supplier of the product will then confirm in a reasonable time by any suitable means (e.g. by telephone, by e-mail, etc.) the purchase/order made, in order to identify and correct any errors and to avoid unwanted orders from the unfamiliar consumer before shipping the order. The language in which purchases can be made is Greek.
The Company is not responsible for delays in execution (including delivery) due to circumstances beyond its fault or due to force majeure and shall be entitled to an extension of time for execution. Examples may be strikes, acts of terrorism, war, transportation / production problems, governmental or legislative acts, and natural disasters. If such incidents last more than one month, this contract may be terminated without compensation by either party.
The Company guarantees that it does not archive credit card numbers and their security information in any way, as any registration on the part of users/visitors is done on a third party website, secure and certified. Therefore, the Company cannot be held responsible for any misuse of the relevant data.
After receiving the product, the user/visitor, if he is not satisfied with the purchase, has the right within 14 calendar days from receiving it, after contacting the same day or the next working day to the contact details of the supplier of the product as stated in relevant document and mentions the full details of the same and the order, to send the product to the address of the supplier as stated in the corresponding document, filling in the withdrawal form and in the condition in which he received the product. According to the law, returns are accepted as above only if the products you wish to return are in the same condition in which you received them, i.e. without their packaging being unsealed or tampered with, accompanied by the retail sales receipt or invoice.
Intellectual and industrial property rights
Apart from the expressly mentioned exceptions (copyrights and trademarks of third parties, partners and entities), all the content of the Eshop, including images, graphics, photographs, designs, texts, the services provided and generally all the files of this Eshop, are intellectual property, registered trademarks and service marks of the Company and are protected according to the relevant provisions of Greek law, European law and international conventions. Consequently, none of them may be in whole or in part sold, copied, modified, reproduced, republished or "uploaded", transmitted or distributed in any way, with the exception of personal use only, i.e. not for public or commercial use and without erasing the indication of their origin by the Company, always without affecting in any way the relevant intellectual and industrial property rights. As an exception, the above may only be allowed under the condition of the Company's prior written consent and as long as they concern the Company's relevant rights.
It is not permitted to create and/or publish a database containing parts of the Eshop without the prior express consent of the Company. The other products or services mentioned on the online pages of this Eshop and bearing the marks of the respective organizations, companies, partner bodies, associations or publications, are their own intellectual and industrial property and therefore they bear the relevant responsibility.
Visitor/user responsibility
The visitor/user of the Company's pages and services assumes responsibility for any damage that may be caused to the Company by bad or unfair use of the Material and the Eshop.
Privacy
The visitor/user can visit the Eshop without revealing his identity and without providing any personal information without his express consent.
However, in order for the visitor/user to be able to place orders and possibly become a recipient of electronic information material (e.g. Newsletters) sent by the Company, in order to be informed about issues concerning both him and the Company as well as his purchases and to receives privileges from the Company in the future, expressly consents by completing the relevant form to register for the Eshop services and to provide the following information (Name, Address, E-mail Address, Telephone) to the Company in order to become its customer. Also, the Company may archive any purchases of its users/visitors in order to upgrade its services while registered users/visitors are given the opportunity to access their possible orders.
Use of Personal Data
The Company fully complies with the provisions of Law 2472/1997 on the protection of personal data. Any processing of users' personal data by the Company is carried out with the express consent of the user, for the following purposes. The purpose of any processing of the users' personal data by the Company is to enable the visitors/users of the Eshop to place orders, to receive in the future electronic information material (e.g. Newsletters) from the Company on matters concerning the visitors/users, also the future communication or information about the Company's products and services and the future provision of privileged services by the Company regarding the use of the Eshop, as well as in order to upgrade its services. The information voluntarily provided by the users of the Eshop is used in order for its users to have direct and meaningful communication with the Company and the advertised suppliers of the products, to provide them with answers to specific questions they ask and finally to be served and executed according to optimal their orders. The Company does not distribute to any other organization or partner that is not connected with it the electronic addresses or any other information concerning its users and customers except to the advertised suppliers of the products for the purposes of purchasing them.
Disclosure of Personal Data
The Company has the right to disclose any personal information that users provide to third parties that are not subsidiaries or affiliated companies exclusively in the following cases:
(a) in order to comply with requirements of law, court orders or government regulations;
(b) in order to defend and protect its rights or property;
(c) in order to act under exigent circumstances to protect the personal safety of its users, its Internet Sites or the public.
Data protection
The Company is committed to protecting the personal information and data provided by visitors/users. For this purpose, it has taken the necessary technical security and organizational measures for the processing of users' personal data. The personal information collected is stored on password-controlled limited access servers and the Company uses special technologies and procedures to enhance the protection of this information against loss or misuse as well as to protect it from unauthorized access, disclosure, modification or destruction. However, although the Company makes every effort to protect the above data, it cannot guarantee that the above technologies and procedures will never be compromised in any way.
To this end, if any visitor/user becomes aware of any illegal, malicious, inappropriate or unfair use of personal data, which is related in any way to the use of the Eshop, he undertakes the obligation to notify the Company immediately. Otherwise, he will also be liable to the Company.
Access and objection rights
The users of the Eshop have the right to be informed by the Company and the suppliers of the products of the Space regarding whether the personal data concerning them are the subject of processing by the Company and/or to object to the processing of the personal data concerning them and in particular to request their correction, temporary non-use, blocking, non-transmission or even deletion. The relevant application regarding the Company should be signed, in writing and relate to a specific request and/or action, to be sent to the following address: Aristokleous 14, Acharnes, 13671, Attica marked "Eshop - Data" and be accompanied by supporting documents on the identity of the applicants. The Company is obliged to respond in writing within an exclusive period of fifteen (15) days from the receipt of the relevant application.
Contact
As far as the Company is concerned, in order for the user to exercise the rights of information, access and objection (Articles 11, 12 and 13 respectively of Law 2472/1997) he can contact the competent controller of the Company at the address 103 Aristotelous Str. Acharnes, 13671, Attica "Eshop - Data" as well as the contact numbers as mentioned in the relevant section.
Non-personal information
When visiting the Company's Eshop, it is possible to collect some information that cannot be associated with a specific person (non-personal identification), which exclusively helps the Company to provide better services to its customers. For example, the "domains" from which the visits come are recorded and the activities of the visitors to the Company's websites are measured, but in such a way that the data collected remains non-personal, i.e. unable to determine the identity of the user. This information is also called "clickstream" data and is used and analyzed only in aggregate, for the purpose of understanding trends and patterns. The above information is not reviewed at the level of individual users. The Company may use this information to analyze trends and statistical data and thereby provide better services to its customers.
The collection of the above information is carried out through so-called "cookies". This technology does not collect personal information. A cookie is a set of data in the form of a small anonymous trace ("text file") which can be sent by the Eshop to the browser of the user's computer, then stored there and through it the user's computer can be identified, but not the user himself. Cookies help in many ways to make the visit to the Company's Eshop more fun and interesting for the user. The user can, if he wishes, completely disable cookies in his browser. However, if this is done, some websites may not function properly.
Limitation of the Company's liability
Under any circumstances, including the case of negligence, the Company is not responsible for any form of damage suffered by the visitor/user of the Company's pages, services, options and contents which he/she proceeds with on his/her own initiative and with the knowledge of the terms herein.
The Company makes every effort for the accuracy of the information it presents. The contents of the Eshop are provided "as is" without any warranty expressed and/or implied in any way. Therefore, the Company does not bear any responsibility arising from the information, products and companies it mentions, as long as the aforementioned are presented exactly as they are presented. The Company does not guarantee that the pages, services, options and contents will be provided without interruption, without errors and that errors will be corrected.
Also, the Company does not guarantee that the same or any other related site or the "servers" through which they are made available to you, are provided to you without "viruses" or other harmful components. The possible cost of possible - as above - corrections or services, is assumed by the visitor/user and in no case by the Company.
Links to other sites
The Company does not control the availability, content, personal data protection policy, quality and completeness of the services of other web sites and pages to which it refers through "links", hyperlinks or advertising banners. Therefore, for any problem that occurs during their visit/use, the visitor/user must contact the respective web sites and pages directly, which are responsible for the provision of their services. In no case should the Company be considered to endorse or accept the content or services of the web sites and pages to which it refers or to be connected with them in any way.
Newsletters
Any electronic informational material (e.g. Newsletters) sent by the Company from time to time is the intellectual property of the Company and is therefore protected by the relevant provisions of Greek legislation and international conventions. The Company reserves the right not to register a person in the recipient lists or to delete him from them. In order for the visitor/user to receive electronic information material (e.g. Newsletters) of the Company, he expressly consents to his registration in the Eshop services and to the provision of the following information (Name, Address, E-mail Address, Telephone) to the Company, which are subject to in the terms of Personal Data Protection – as above. The user is given the possibility to delete it from the respective lists in each sending of electronic informational material (e.g. Newsletters).
Security
Although the Company makes every effort to protect the Eshop from digital sons and/or any other type of harmful or destructive files and/or programs designed to interfere with, destroy or limit the operation of any software or telecommunications equipment, it cannot guarantee that the Eshop will never be affected by such elements. Therefore, the integrity and safeguarding of the software systems and equipment of each visitor/user is the responsibility of the visitor/user and the Company will not bear any responsibility in case of damage to the electronic equipment (software and hardware) of the users by "sons" and other harmful files such as these are set out above.
Violation of terms of use
In any case of violation of these Terms of Use, the users will be obliged to compensate for any positive and/or consequential loss of the Company. The Company's non-exercise of its rights deriving from these Terms of Use does not imply a waiver of these rights. The Company expressly reserves the right to supervise the application of these rules at its absolute discretion.
Final Disposition
This agreement is governed by Greek law. Any dispute, disagreement or conflict regarding the execution, application or interpretation of this and in general what concerns the relationships that will be created from it, will be resolved by the Courts of Athens, which are hereby made exclusively competent.
